A small employer has little negotiating power at renewal, and the carrier sets the increase. With ICHRA you set the budget instead.
DFW, Houston, San Antonio, Austin, El Paso, one group plan network doesn't serve all these markets equally well.
You're paying group plan premiums for a headcount that fluctuates. ICHRA adjusts with your workforce naturally.
You define the contribution per employee, or per class. Your monthly health cost becomes a fixed line item.
Strong carrier competition in DFW, Houston and Austin means employees find real coverage at real prices.
Employees submit premium receipts. You reimburse up to the allowance, tax-free. Fully deductible for you.
ICHRA meets ACA requirements when structured correctly. No annual renewal negotiation. No group plan admin.
Less than most employers expect, because ICHRA is a federal arrangement. Texas has no state ICHRA statute, so the rules come from the federal regulation at 26 CFR 54.9802-4: you define employee classes, offer the same allowance to everyone in a class (it can rise with age, up to three to one), and reimburse premiums tax-free. What Texas changes is the market your employees shop in, who regulates the carriers, and how the state's Medicaid decision affects your lowest-paid staff. Those three points are where a Texas setup goes right or wrong.
The Texas Department of Insurance (TDI) licenses the carriers and agents who sell individual plans in the state and handles consumer complaints. Its consumer help line is 800-252-3439 and its health insurance guides are at tdi.texas.gov. TDI does not run enrollment. The ICHRA itself sits under federal law, so the IRS and the Department of Labor set the rules on classes, notices and affordability, while TDI oversees the plans your employees end up buying with the allowance.
HealthCare.gov. Texas has never built its own exchange, so employees enroll through the federal marketplace or buy an ACA-compliant individual plan directly from a carrier. Open enrollment for 2027 coverage runs from November 1, 2026 to January 15, 2027, according to HealthCare.gov, and a plan chosen by December 15 starts on January 1. If your ICHRA starts at another point in the year, employees use the 60-day Special Enrollment Period that comes with gaining access to an ICHRA.
Texas is one of the ten states that have not adopted the ACA Medicaid expansion, according to the KFF state tracker. In practice, a Texas employee earning between 100% and 138% of the poverty line can qualify for marketplace premium tax credits instead of being routed to Medicaid. An affordable ICHRA offer cancels those credits. For a low-wage class, that can leave an employee worse off than with no offer at all, so run the ICHRA affordability calculator before you set the allowance for hourly staff.
It simplifies it. Texas has no personal income tax, so ICHRA reimbursements are tax-free at the federal level and there is no state return where an employee could owe tax on them. Your allowance is a deductible business expense on the federal return, and employees keep the full amount. What Texas does not add is a state incentive on top: the Texas ICHRA tax credit bill, SB 1949, never got past the Senate Finance Committee, and we explain what happened in Texas ICHRA tax credit 2026: the bill that never passed.
Ready to set one up? The step-by-step sequence, from classes to the 90-day notice, is in how to set up an ICHRA in Texas. For a worked example, see ICHRA for Texas restaurants with 8 to 15 employees.
Does ICHRA work for Texas employers spread across DFW, Houston, Austin, and San Antonio?
Yes, and this is one of ICHRA's biggest advantages for Texas employers. Instead of one group plan network that serves some markets better than others, each employee shops for a plan in their own metro area. DFW, Houston, Austin, and San Antonio all have strong individual market competition.
Can Texas employers offer different ICHRA allowance amounts to different types of employees?
Yes. ICHRA allows employers to define employee classes, such as full-time, part-time, salaried, hourly, or by location, and set different allowance amounts for each class. The class definitions must follow IRS rules, but the flexibility is substantial. A licensed agent can help you structure the classes correctly.
What's the tax advantage of ICHRA for Texas employers specifically?
Texas has no state income tax, which means the federal tax benefits of ICHRA, employer contributions are fully deductible, and reimbursements are tax-free for employees, are the full picture. There's no state-level tax treatment to navigate. The deduction runs directly against your federal business income.
Can a Texas employer switch from a group plan to ICHRA mid-year?
Yes. An ICHRA can start on the first of any month, and gaining access to one gives employees a 60-day Special Enrollment Period to buy a HealthCare.gov plan, so nobody has to wait for open enrollment. What needs planning is the notice: employees should get the written ICHRA notice at least 90 days before the plan year starts, and the group plan should end the day before the ICHRA begins so there is no gap.
Does Texas have its own ICHRA law or an ICHRA tax credit?
No. Texas has no state ICHRA statute, so Texas employers follow the federal rule at 26 CFR 54.9802-4. There is also no Texas ICHRA tax credit in 2026: the bill that proposed one, SB 1949, never got past the Senate Finance Committee. The tax benefit is the federal one, a deductible business expense for you and tax-free reimbursements for employees.
Where do Texas employees buy their ICHRA plan?
On HealthCare.gov. Texas does not run its own exchange, so employees use the federal marketplace or buy an ACA-compliant individual plan off-exchange. Open enrollment for 2027 coverage runs from November 1, 2026 to January 15, 2027, and a plan picked by December 15 starts January 1. Outside that window, the ICHRA Special Enrollment Period applies.
