ICHRA for a Small Business Under 50 Employees: What Changes Below the ALE Line?
Below the 50-employee line there is no employer mandate payment, so ICHRA affordability matters for employees' tax credits, not for penalties.
Key takeaways
- An employer under 50 full-time employees, counting full-time equivalents, owes no section 4980H employer mandate payment, whatever health benefit it offers (IRS).
- Affordability still matters: for 2026 an ICHRA is affordable when the employee's cost for the lowest cost silver plan, after the allowance, is at most 9.96% of household income, and an affordable offer ends Marketplace premium tax credit eligibility.
- QSEHRA is limited to employers that are not ALEs and offer no group plan, capped at $6,450 self-only and $13,100 family for 2026. ICHRA has no cap and no size limit.
- Setup takes employee classes, a notice at least 90 calendar days before the plan year, coverage substantiation and a reimbursement process. For some very small teams, something else fits better.
Does a business under 50 employees face an employer mandate penalty for an ICHRA?
No. The employer shared responsibility provisions in section 4980H apply only to applicable large employers (ALEs), meaning employers that averaged at least 50 full-time employees, counting full-time equivalents, during the prior calendar year, according to the IRS. An employer below that line owes no 4980H payment, however an ICHRA allowance compares with the Marketplace.
The count includes part-time hours. Full-time means at least 30 hours of service per week or 130 hours in a month, and part-time hours convert to full-time equivalents at 120 hours each, capped at 120 per employee. A business with 38 full-time employees and 24 part-timers averaging 70 hours a month has 38 + 14 = 52 full-time equivalents, so a modest payroll can still be an ALE. Employers under common ownership are combined, and the test averages the 12 months of the prior year, rounding down. The ACA employer mandate calculator runs the count and shows the 2026 payment amounts of $3,340 and $5,010 per employee (Rev. Proc. 2025-26).
Proc. 2025-26).
If there is no penalty, why does ICHRA affordability still matter?
Affordability decides whether employees keep access to the Marketplace premium tax credit. Under 26 CFR 1.36B-2(c)(5), an ICHRA is affordable for a month when the required HRA contribution, the lowest cost silver plan premium for self-only coverage minus the monthly allowance, is at most 1/12 of household income times the year's percentage: 9.96% for 2026 and 10.22% for 2027.
A hypothetical shows the effect. With a lowest cost silver premium of $450 a month and an allowance of $200, the required HRA contribution is $250. For an employee with $40,000 of household income, 9.96% divided by 12 allows $332, so the offer is affordable and the employee cannot claim the credit, even without using the allowance. For an employee with $30,000, the limit is $249, so the offer is unaffordable by $1. That employee can choose the ICHRA or the credit, not both, and must decline the ICHRA to take the credit, as HealthCare.gov and the IRS explain.
Employers usually do not know each person's household income, so the Marketplace makes the determination when the employee applies, using the offer details the employee reports. Below 50 employees, no 4980H payment hangs on the result; the effect lands on each employee's credit eligibility. The ICHRA affordability calculator runs the test for a specific employee and ZIP code.
| Employer size | 4980H payment | What ICHRA affordability changes |
|---|---|---|
| Under 50 full-time employees (with FTEs) | None | Each employee's eligibility for the premium tax credit |
| 50 or more (ALE) | Possible: $3,340 or $5,010 per employee in 2026 | Credit eligibility, plus payment exposure |
Should a small employer choose ICHRA or QSEHRA?
The answer depends on size, contribution level and plans. QSEHRA (Qualified Small Employer Health Reimbursement Arrangement): an HRA open only to employers that are not ALEs and offer no group health plan to any employee. has 2026 limits of $6,450 self-only and $13,100 family (IRS Notice 2017-67, Rev. Proc. 2025-32). ICHRA has no employer-size limit, and HealthCare.gov says it has no annual minimum or maximum contribution.
The arrangements also differ in structure. Notice 2017-67 requires a QSEHRA to be provided on the same terms to all eligible employees, while an ICHRA lets the employer set allowances by employee class. An ICHRA can run beside a group plan offered to a different class, but not to the same class (26 CFR 54.9802-4). On credits, the IRS says an affordable QSEHRA ends credit eligibility, and an unaffordable one reduces the credit by the monthly permitted benefit, so the employee keeps part of it. An unaffordable ICHRA forces an either-or choice instead.
| Feature | ICHRA | QSEHRA |
|---|---|---|
| Employer size | Any | Not an ALE |
| 2026 contribution limit | None | $6,450 self-only, $13,100 family |
| Group plan alongside | Yes, for a different class | No group plan for any employee |
| Allowance by class | Yes | Same terms for all eligible employees |
| If the offer is unaffordable | Employee chooses ICHRA or credit | Credit reduced by the permitted benefit |
An employer that expects to cross 50 should note that QSEHRA stops being available once it is an ALE. The ICHRA vs QSEHRA comparison for small businesses works through the trade-offs in more detail.

Under 50 full-time employees, an ICHRA carries no 4980H penalty. What the allowance decides is whether each employee keeps the premium tax credit.
What does a small employer actually need to set up an ICHRA?
A small employer needs five things under 26 CFR 54.9802-4: employee classes defined before the plan year, an allowance offered on the same terms within each class, a written notice to each eligible employee at least 90 calendar days before the plan year, a once-per-plan-year right to opt out, and a way to confirm that each participant holds individual coverage.
Three details matter at small scale. An employer first established fewer than 120 days before its first plan year can deliver the notice by the date the ICHRA takes effect, for that first plan year only. The class-size minimum, 10 employees for an employer with fewer than 100, applies only when the employer offers a group plan to some classes and an ICHRA to others, so an employer offering an ICHRA to everyone has no minimum to meet. And the employer needs at least one employee who is not a self-employed owner or the owner's spouse, per HealthCare.gov.
Tres detalles importan a escala pequeña.
The rule describes what the plan must do and does not name a vendor to do it. Most small employers run reimbursements through an administration platform, and employees enroll in individual plans on the Marketplace or with a licensed agent. The guide to who sets up an ICHRA for a small business separates the administrator, agent and specialist roles.

| Vendor | What its own page says |
|---|---|
| PeopleKeep | Employers with at least one W-2 employee can offer an ICHRA, and the site has a section for organizations with fewer than 50 employees |
| Take Command | Its ICHRA is designed for employers of any size, and it offers a separate QSEHRA product for companies with up to 49 employees |
| Thatch | Describes benefits for businesses of all sizes, with separate paths for startups, small businesses, mid-market and enterprise |
InsureICHRA is one option for the design side. It designs and runs ICHRAs for employers nationwide, selects the administration platform and works with licensed agent partners for employee enrollment. It is not an insurance agency, carrier or law firm. We are paid when an employer we advise puts an ICHRA in place and their people enroll through our licensed agent partners. When is an ICHRA not worth it at a very small headcount?
An ICHRA is not worth it when the business has no employees besides its owners, when one group plan is wanted for everyone, or when staff would lose Marketplace credits larger than the allowance. For 2026, an offer that clears 9.96% of household income ends credit eligibility whether or not the employee uses the allowance.
Each case has a rule behind it. HealthCare.gov says an ICHRA is for employees, not self-employed owners or their spouses. An employer cannot offer one class a choice between a group plan and an ICHRA (26 CFR 54.9802-4). And the credit trade-off is the one small employers tend to miss: an employee who would have received a larger credit than the allowance the employer can fund may end up with less help, not more. Group plans, a QSEHRA or no offer can be the better answer for some teams.
